Online Order Terms & Conditions

PLEASE READ THESE TERMS AND CONDITIONS OF SALE CAREFULLY – THEY CONTAIN TERMS WHICH WILL BE BINDING UPON YOU WHEN YOU PLACE AN ORDER.

Orders

By placing an order on this web site you are making an offer which, if accepted by us, will constitute a binding agreement between us. 
You are responsible for ensuring the accuracy of the terms of any order you submit.
No order shall be deemed to be accepted by us unless and until it is confirmed by email or in writing by us and payment has been taken from your payment card. We reserve the right to reject any order. 
Any advice or recommendation given on this web site or otherwise given to you by us, or any of our employees or agents, is followed or acted upon entirely at your own risk and, accordingly, we shall not be liable for such advice or recommendation.


Price


The price of the Goods will be the price set out on the relevant page of this web site together with delivery charges as set out in the ‘Delivery’ section below. 
We reserve the right to change the prices at any time. 
Prices for Goods on this web site are shown in Australian Dollars (AUD) and are inclusive of UK VAT of 15%, or 5% for original Works of Art. However you will be liable for any import duties and local sales taxes that may be levied in the country of delivery. 
Transactions authorised on this site will appear on your credit card statement as “MC Sunday & Rex”.

Transaction Information

Transactions will be effected in pounds sterling (GBP) and, where applicable, converted to your home currency at the rate prevailing on the date of the transaction.

The cardholder will be debited immediately upon the completion of the transaction.

The cardholder should print out all transaction data and keep it in an easily accessible place.
An Invoice will be issued as soon as the cardholder’s payment has been received.

Product availability and descriptions

The majority of our products are made to order by hand. The image representing the products featured on our website are intended as a guide only, and all products made to order will differ slightly from what is represented on the website. This is due to the nature of the material and hand-made quality of the pieces, and it also ensures no two items are ever the same; each item sold by Sunday&Rex is unique.
We take care to ensure that all product information and pricing featured on this web site is accurate and up-to-date. However, we are unable to guarantee the prices or description of the Goods and reserve the right to make alterations without prior notice. 

The representation of colours on your browser may vary from the actual colours. Product images are reproduced with the consent of the owner or licence holder of the copyrights and trademarks in such products.

Every care is taken to ensure descriptions and measurements are accurate, however slight variations may occur. Length measurements are approximate and vary according to the size of the item.


All Goods are subject to availability. In the event that your ordered goods are not available we will:
(a) notify you and no payment will be taken; or
(b) if we have already taken payment from your card, notify you and credit your card with the sum that we have taken.

Cancellation and returns

You may cancel your order without having to give a reason for up to 7 days after the date upon which you ordered the Goods.

Goods that you do not wish to keep must be returned to us within 14 days of receipt in the condition in which they were received, together with a covering letter (detailing your order number, date of order, the delivery address and your contact details) and the original delivery note to enable us to process your request promptly. Once we have received the Goods, we will credit the payment card that you used for payment or, if you prefer, replace the Goods with alternative goods.

To cancel your contract you must notify us in writing, either to info@sundayandrex.com, quoting your name and order reference, or by post to 38 Saltram Cres. London W9 3HR.
The product you return must be in new, unused, condition with all the original packaging and product tags still attached. New and unused means that there are no marks on the item or any wear on the tags. We will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser. All accurately returned products will be credited to the original purchaser’s credit or debit card excluding delivery costs.

Goods that have been made to order, personalized, commissioned, custom made or ordered in a specific finish or colour as per the customer's specifications cannot be returned. If received damaged or defective then a replacement will be manufactured and delivered as replacement as soon as possible.

Please only order if you are sure that the item and finish is right for your needs as you will not be able to change the order after the item has been entered into production, unless we have not supplied the correct item or specification as per the order confirmation.
Also be careful to check access to your property as delivery is on the basis that you have checked the dimensions of the item and that it fits through all doorways, stairwells and within the area of intended use.

Goods which have been used or damaged after delivery (except where the Goods are defective, excluding wear and tear or wilful damage or negligence of anyone other than us, our contractors or agents) also cannot be returned.

We will not be responsible for returned Goods that are lost or damaged in transit. Proof of postage will not be accepted/deemed as proof of receipt/delivery. You should take reasonable care to ensure that the Goods returned to us are not damaged in transit and if appropriate arrange suitable insurance. 
Please note that in the case of:
Non-defective Goods, you will be responsible in full for the cost of safe delivery back to us;
Defective Goods (excluding wear and tear or wilful damage or negligence of anyone other than us, our contractors or agents), the reasonable costs of safe delivery back to us will be refunded to you in full.

We reserve the right to cancel the contract between us if:

We have insufficient stock to deliver the goods you have ordered, or the designer of the goods is unable to produce the work.

We do not deliver to your area.

One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers. If we do cancel your contract we will notify you by e-mail and will re-credit to your account any sum deducted by us from your credit card as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.

Delivery

Please note that Sunday&Rex supports young emerging designers. The majority of our designed objects and artworks are made by hand, to order. Because of this, the majority of our collection is ‘by order’ only (unless we have the item in stock). Because all of the goods are made to order, we are unable to guarantee delivery dates for your order. We endeavour to ship the delivery to you as soon as possible. In most cases you will receive your goods within 5 weeks. We will notify you if we are unable to do this.

Delivery dates acknowledged by Sunday&Rex are non-binding estimates only, based upon the best available information concerning manufacturers lead times and transportation schedules. Therefore orders may be shipped on the estimated date, prior to the estimated date with the buyers' approval or after the estimated date (after notification to the buyer). Estimated delivery dates will be considered as accepted by the buyer unless disagreement is notified to the Company in writing within seven days of order placement.

Special delivery conditions requested by the buyer should be given in writing at the time of order placement and will be considered by the Company and if necessary conditions and charges may change accordingly. From delivery or placement into storage all risks for the goods pass to the buyer.

Items ordered over the internet must be delivered to a UK address.  A UK address is defined as being in England, Northern Ireland, Scotland or Wales and includes the Isle of Man, the Channel Islands and BFPO addresses.

To request an overseas delivery please contact us at info@sundayandrex.com.  Deliveries to addresses outside of the UK may carry an additional charge.  Local import duties may also be payable by the customer upon receipt.  We reserve the right not to deliver overseas if we believe the address is not secure, for example PO Box addresses and certain countries.

For UK delivery we ship smaller items through Royal Mail/Parcel Force, and larger items through a courier company.


Privacy
Your privacy is important to you and to us. Please see our Privacy Policy for details of what information we collect and how we will use and protect it.

Governing law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.



Errors

Any typographical, clerical or other error or omission on any page of this web site shall be subject to correction without any liability on our part.



Liability


You should notify us of any claim by you which is based on any damage to the Goods at the time of delivery or their failure to correspond with the description within 14 days from the date of delivery. If you do not notify us within the required timescales it may be harder for you to prove that the damage occurred before delivery.


If any Goods are defective and you notify us of the defect within 12 months of the date of delivery of the Goods, we will (at our discretion) either replace them or refund you in full the price of the defective Goods. This quality guarantee does not apply where the defect is due to fair wear and tear, not adhering to the Care Instructions provided, wilful damage by or negligence of anyone other than us, our contractors or agents.


In the event that a valid claim in respect of any of the Goods which is based on any defect in the quality or condition of the Goods and is notified to us in accordance with these Terms and Conditions, we (at our sole discretion) shall either replace the Goods free of charge or refund to you the price of the Goods but we will have no further liability to you. 
We shall not be liable for any loss or damage (in contract, negligence or otherwise) where: 
(a) there is no breach of a legal duty of care owed to you by us; or 
(b) the loss or damage is not a reasonably foreseeable result of any such breach; or
(c) the loss or damage is an indirect result of any such breach; or
(d) any increase in loss or damage results from a breach by you of these Terms and Conditions.
Nothing in these Terms and Conditions excludes or limits our liability for fraudulent misrepresentation or for death or personal injury caused by our negligence. These Terms and Conditions do not exclude or restrict the liability of us towards you as a consumer within the Unfair Terms in Consumer Contracts Regulations 1999, the Unfair Contract Terms Act 1977 or the Consumer Protection (Distance Selling) Regulations 2000. 
Your statutory rights are not affected by these Terms and Conditions. 
We shall have the right to suspend or cancel our obligations (without liability to you) in whole or in part if we are delayed or prevented from carrying on our business or any of our obligations under these Terms and Conditions due to any circumstance beyond our reasonable control. 
Any intellectual property rights created by us in the course of performance of our obligations under these Terms and Conditions shall remain our property. Nothing in these Terms and Conditions shall be deemed to have given you a licence or any other rights to use the intellectual property rights owned by or licensed to us. 
No third party shall have the benefit of or the right to enforce these Terms and Conditions under the Contracts (Rights of Third Parties) Act 1999 or otherwise. 
The Goods are sold for personal use only and not for resale.

Events beyond our control

We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

Entire agreement

These Terms & Conditions, together with our current website prices, delivery details, contact details and Privacy Policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

Governing law

The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
